Privacy Policy

At Tidal Swimwear ("we", "us", "our"), we take your privacy seriously. This Privacy Policy explains what personal information we collect, how we use it, and what rights you have over it. This policy applies to tidal-swimwear.co.uk and any related services.

We are committed to handling your personal data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Who We Are

Tidal Swimwear is a London-based premium swimwear brand. We are the "data controller" for the personal information you share with us. If you have questions about this policy or how we handle your data, you can reach us at hello@tidal-swimwear.co.uk.

What Information We Collect

We only collect information that helps us run our business properly and serve you well. This may include:

  • Contact details — your name, email address, phone number, billing and shipping address
  • Order details — products purchased, payment method (we do not store full card details), order history
  • Communications — messages you send us via our contact form, email, or social channels
  • Newsletter signups — your email address when you join our newsletter
  • Website usage — pages you visit, time spent, device type, approximate location (collected via cookies and analytics tools)

How We Use Your Information

We use your personal information to:

  • Process and fulfil your orders
  • Provide customer service and respond to your enquiries
  • Send you order updates, shipping confirmations, and delivery information
  • Send you marketing emails about new collections, restocks, and offers — but only if you've opted in
  • Improve our website, products, and customer experience
  • Detect and prevent fraud
  • Comply with our legal obligations

The Legal Basis for Using Your Data

Under UK GDPR, we rely on the following legal grounds:

  • Contract — to process orders and deliver goods you've purchased
  • Consent — for marketing emails, newsletter signups, and certain cookies
  • Legitimate interest — to improve our products and service, prevent fraud, and run our business effectively
  • Legal obligation — to comply with tax, accounting, and consumer protection laws

Who We Share Your Information With

We never sell your data. We only share it with trusted partners who help us run our business:

  • Shopify — our e-commerce platform, which processes orders and stores customer data
  • Payment processors (such as Shopify Payments, PayPal, Apple Pay) — to process your payment securely. We do not see or store your full card details.
  • Delivery couriers (such as Royal Mail, DPD) — to deliver your order to you
  • Email service providers — to send order updates and marketing emails (if opted in)
  • Analytics providers (such as Google Analytics, Meta) — to understand how our website is used and improve it
  • HMRC and other authorities — where required by law

How Long We Keep Your Data

We keep your personal information only for as long as we need it:

  • Order information — for at least 7 years, to comply with UK tax and accounting requirements
  • Newsletter signups — until you unsubscribe
  • Contact form messages — for up to 2 years
  • Website analytics — for up to 14 months

Your Rights

Under UK GDPR, you have the right to:

  • Access the personal data we hold about you
  • Correct any inaccurate information
  • Delete your personal data (subject to legal exceptions)
  • Restrict or object to how we process your data
  • Withdraw consent at any time (for example, by unsubscribing from our newsletter)
  • Lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk

To exercise any of these rights, email us at hello@tidal-swimwear.co.uk. We'll respond within one month.

Cookies and Tracking

We use cookies and similar technologies on our website. See the Cookie Policy section below for full details.

International Transfers

Some of our service providers (such as Shopify and Google) may transfer your data outside the UK or European Economic Area. When this happens, we make sure those providers offer an equivalent level of data protection — typically through Standard Contractual Clauses or adequacy decisions.

Security

We take security seriously. Our website uses HTTPS encryption, and we work only with trusted, vetted partners. While no online service can be 100% secure, we follow industry-standard practices to protect your information.

Children

Tidal Swimwear is not intended for children under 16. We do not knowingly collect data from anyone under 16. If you believe we've collected such data, please contact us.

Changes to This Policy

We may update this policy from time to time to reflect changes in our practices or the law. The "Last updated" date above will always show the latest version. Significant changes will be communicated via email or a website notice.

Terms of Service

Welcome to Tidal Swimwear. These Terms of Service ("Terms") govern your use of our website, tidal-swimwear.co.uk, and any purchases you make from us. By using our website or placing an order, you agree to these Terms. Please read them carefully.

About Us

Tidal Swimwear is a London-based premium swimwear brand. We design our pieces on the shores of St Tropez and craft them with care in the United Kingdom.

You can reach us at hello@tidal-swimwear.co.uk or via our contact page.

Placing an Order

When you place an order with us:

  • You confirm that you are at least 18 years old, or have permission from a parent or guardian
  • You confirm that the information you provide is accurate
  • Your order is an offer to buy — a binding contract is formed only once we send you an order confirmation email
  • We reserve the right to refuse or cancel any order at our discretion (for example, in the case of stock errors, pricing errors, or suspected fraud)

Prices and Payment

All prices are listed in pounds sterling (£GBP) and include UK VAT where applicable. Prices may change at any time, but changes will not affect orders we've already accepted.

Payment is taken at checkout via our secure payment partners. We accept major credit and debit cards, Apple Pay, Google Pay, PayPal, and Shop Pay.

We never see or store your full card details — these are handled directly by our payment processors.

Shipping and Delivery

Full shipping information, including timelines and delivery costs, is set out on our Shipping & Returns page. By placing an order, you accept the shipping terms in force at the time of purchase.

Risk of loss passes to you once the goods are delivered to the address you provided.

Returns and Refunds

Our returns policy is set out in full on our Shipping & Returns page. In summary:

  • You have 14 days from receipt of your order to request a return
  • Items must be unworn, with original tags and hygiene seals intact
  • For hygiene reasons, swimwear bottoms must be tried on over underwear, and the hygiene strip must remain in place
  • Refunds are issued to the original payment method within 14 days of receiving the returned item

This does not affect your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015.

Faulty or Damaged Items

If your order arrives faulty, damaged, or incorrect, please email us within 14 days at hello@tidal-swimwear.co.uk with photos. We will arrange a replacement, repair, or refund at no cost to you.

Care of Your Swimwear

To get the most from your Tidal pieces, please follow the care instructions provided. Damage caused by misuse, improper washing, or harsh chemicals (such as suncream, chlorine if rinsed improperly, or hot tubs) is not covered by faults.

Intellectual Property

All content on our website — including text, photography, illustrations, logos, designs, and brand identity — is the property of Tidal Swimwear or our licensors. You may not copy, reproduce, or use any of this content for commercial purposes without our written permission.

User Conduct

When using our website, you agree not to:

  • Misuse the website (for example, by attempting to hack it or upload malicious code)
  • Submit false or misleading information when placing orders
  • Infringe our or anyone else's intellectual property rights
  • Use the site in any way that breaches UK law

Newsletter and Marketing

By signing up for our newsletter, you agree to receive marketing emails from us. You can unsubscribe at any time via the link in any email or by contacting us directly.

Our Liability

We take care to ensure our products and website meet a high standard. However, to the extent permitted by law, we are not liable for:

  • Indirect or consequential losses
  • Loss of profit, business, or goodwill
  • Damage caused by misuse of our products
  • Issues caused by third parties (such as couriers or payment providers)

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or anything that cannot be excluded under UK law.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they were last changed. The version in force at the time of your order is the one that applies to that order.
